Abstract
Technological evidence is used to bolster conflicts in divorce cases throughout several processes in both the District Court and the Religious Court. This research seeks to identify the variables influencing judges' selection of electronic evidence, evaluate the legal validity of electronic evidence in divorce cases, and examine the need for regulation of electronic evidence under civil procedural law. This study employs an empirical research technique including a conceptual framework and a case study approach. The used data sources include both primary and secondary sources. Primary data is derived from divorce case rulings No. 115/Pdt.G/2020/PN.Skh from the Sukoharjo District Court and No. 397/Pdt.G/2019/PA.Skh from the Sukoharjo Religious Court, in conjunction with relevant laws and regulations. Secondary evidence is derived from literature and literature reviews that reinforce case determinations. Data were examined using deductive and descriptive methodologies. The study results indicate that the court acknowledges electronic evidence as acceptable in divorce proceedings, but with certain limits, due to its lack of regulation under the Civil Code, BW, or RBg. Furthermore, electronic evidence derived from Law Number 11 of 2008 about Electronic Information and Transactions (ITE) remains ambiguous.
