Abstract
This study aims to analyze and compare the fatwas issued by the Indonesian Ulama Council (MUI) and the Senior Scholars Commission (Hay'at Kibar al-‘Ulama) in Saudi Arabia regarding the contract of "Ijarah Muntahiya Biltamlik" (lease-to-own). This contract, which combines the elements of both lease and sale, provides the lessee with an option to purchase the leased asset at the end of the lease term. While this contract offers a viable financing solution for market needs, it raises important legal and Islamic jurisprudential questions regarding its compliance with Shariah principles.This research highlights the doctrinal differences between the two prominent Islamic scholarly institutions. The Indonesian Ulama Council permits the lease-to-own contract under certain conditions, while the Senior Scholars Commission in Saudi Arabia takes a more cautious stance, fearing that the combination of two contracts in one may lead to gharar (uncertainty) or riba (usury). The study investigates the underlying reasons for these differences, including the cultural, social, and political influences in both Indonesia and Saudi Arabia. Additionally, the research explores the implications of these fatwas on the practice of Islamic finance in both countries.Through this comparative analysis, the study seeks to provide recommendations for harmonizing fatwas on the lease-to-own contract, contributing to the enhancement of the credibility of Islamic finance and achieving a balance between Shariah compliance and market needs. Ultimately, this research aims to enrich the understanding of contemporary Islamic economic practices and their applications in modern financial systems.
