Abstract

The covid-19 pandemic in Indonesia is increasing day by day. Along with the increase in the number of deaths caused by covid-19, a child is certainly afraid if exposed to covid-19 and has the potential to lose their parents. This study aims to determine the protection of the rights of children who lost their parents due to the co-19 pandemic based on legislation in Indonesia. The approach used in this research is normative, through this approach it aims to determine the implementation of positive law (legislation) and written documents factually in the events of the co-19 pandemic in Indonesia whether the provisions of the legislation have been implemented properly or not. The results of the study show that: (1) children who have lost their parents due to the co-19 pandemic have fulfilled their rights which are regulated under the legal umbrella of child protection; (2) The government has issued regulations and policies to protect the fulfillment of children's rights; (3) there are legal consequences if children's rights are not fulfilled by the government or institutions, parents, and society.
