Abstract

This research examines the juristic perspective on the mudharabah contract in Islamic jurisprudence, and analyzes the application of the mudharabah contract at DISMART (DISMART) in Jember, in accordance with Islamic jurisprudence. This topic is crucial as the mudharabah contract is one of the agreements that facilitate economic transactions in social life. The aim of this research is to understand the reality of mudharabah and analyze how the mudharabah contract is applied between the Faculty of Imam Shafi'i and DISMART. This is a qualitative field research using a descriptive analytical method with a standard approach considered descriptive analysis. Data was collected from primary sources directly involved in the mudharabah contract, parties knowledgeable about the contract as a fabricated factor, as well as from various book sources (both online and printed), scholarly articles from journals, fatwas from the National Sharia Board of the Indonesian Ulema Council (DSN-MUI), Financial Services Authority regulations (OJK), and other data sources. Data analysis techniques employed include data summarization, presentation, and drawing conclusions. Among the significant findings, the researcher concludes that the mudharabah contract between the two parties—the Faculty of Imam Shafi'i for Islamic Studies represented by its manager Aarifin Badri (Rabb al-Maal), and the other party represented by the capital provider (Mudarib)—adheres to Islamic jurisprudence where the essential elements and conditions of the contract are fulfilled.
