Abstract

This research is motivated by the misuse of online platforms that cause damage to one's reputation due to criminal defamation, therefore law enforcement against criminal defamation is needed to protect one's reputation. This research aims to find out the law enforcement of defamation offenses on the Internet in court decisions, and to find out the crime of defamation in terms of positive law and Islamic law. This thesis research uses qualitative research with a normative juridical approach and examines literature sources. The data collection technique used in this research is secondary data, which consists of primary legal materials, secondary legal materials, and tertiary legal materials. The results showed that: (1) the results of the analysis of 3 (three) court decisions used as reference sources, namely Court Decision Number 6/Pid.Sus/2023/PN.Prg; Court Decision Number 197/Pid.Sus/2022/PN.Ksp; and Court Decision Number 178/Pid.Sus/2022/PN. Crp contains a situation called disparity in punishment, (2) legal policy regarding criminal defamation, namely Article 27 paragraph (3) jo Article 45 paragraph (3) of Law Number 19 of 2016 contains multiple interpretations so that a revision is needed, while in Islamic law the law enforcement of criminal defamation is resolved with jarimah ta'zir where the sanctions given are based on the ruler or ulil amri.
