Abstract

This research examines the health considerations of judges in implementing the dispensation of underage marriage, with a focus on a case study conducted at the Religious Court of Wonogiri. The background of this study originates from the fact that early-age marriages still frequently occur in Indonesia, despite existing laws that regulate the minimum age for marriage. The purpose of this research is to comprehend the regulations of marriage dispensation according to the Supreme Court Regulation of the Republic of Indonesia Number 5 of the Year 2019 and the health considerations of judges in granting the request for the dispensation of underage marriage. This study employs a qualitative method with normative and sociological juridical approaches. Data is collected through literature reviews and interviews with judges at the Religious Court of Wonogiri. The research results indicate that the Supreme Court Regulation Number 5 of the Year 2019 provides guidelines for judges to decide on marriage dispensation requests. Judges must consider various aspects of the child's health, including physical and mental maturity, reproductive health, psychological impacts, education, and social well-being before granting the dispensation request. However, challenges in implementing this regulation still exist. Therefore, it is recommended to enhance public counseling and education, strengthen supervision systems, conduct further research, develop support services for children, and establish cooperation with relevant institutions to more effectively protect children's rights and prevent underage marriages.
