Abstract

This research aims to analyze the considerations and criminal implications of additional compensation payments imposed by the panel of judges in the case of Decision Number 51/Pid.Sus-TPK/2020/PN. Smg and his views according to Islam. This research uses a statutory approach and a conceptual approach with legal materials consisting of primary, secondary, and non-legal sources, with the research object being Decision Number 51/Pid.Sus-TPK/2020/PN. Smg. According to the research results, the additional penalty of payment of replacement money was imposed by the panel of judges in case Number 51/Pid.Sus-TPK/2020/PN. Smg is based on Article 18 paragraph (1) letter b regarding state financial losses, retaliation efforts, social protection, and rehabilitation. The implication is that the judge's considerations needed to clearly explain the calculation of state money used by the convict were imperfect, and did not achieve legal objectives. The additional penalty of paying compensation according to Islam can be imposed on the defendant because the assets of Allah SWT are a mandate. Suggestion, the judge should in decision Number 51/Pid.Sus-TPK/2020/PN. Smg the imposition of an additional sentence of payment of replacement money takes into account the economic justice of the Convict, and more thoroughly explains the calculation of state money used by the Convict and the Defendant's assets.
