Abstract

Waqf is a legal act because it involves the transfer of waqif's property rights to the nazhir. Waqf has a function in helping the welfare and progress of society, one of which is waqf land. The waqf system in Indonesia has not been running according to the provisions, resulting in problems such as unregistered waqf land certification. The purpose of this research is to find out how the implementation of waqf land registration and to find out the legal status of waqf land that has not been certified based on positive law. This research uses an empirical juridical approach method and descriptive research type, namely field research by examining applicable legal provisions and the reality that is happening in society. The results of this study indicate that the implementation of waqf land certification at the Bogor Regency BPN Office is in accordance with the procedures listed in Permen Agraria and Spatial Planning Number 2 of 2017. Meanwhile, according to the legal status of waqf land that has not been certified, it remains valid but there is no guarantee of legal certainty.
