Abstract

Buying and selling transactions via the internet are trade transactions that allow buying and selling without having to meet the seller and the buyer directly. In Law no 5 years 1999 is applied in the field of business competition law and is used to assess whether an activity or agreement carried out by a business actor has or has the potential to violate the business competition law. In this research the author uses a type of normative approach method, which is a research method that uses an approach that is carried out by examining and interpreting theoretical matters relating to principles, conceptions ,doctrines and legal norms relating to monopolistic practices and unfair business competition. The regulation of selling at a loss in business competition is contained in Article 20 of Law No.5 of 1999,which regulates that selling at a loss is prohibited by setting very low prices, if this action has the aim of eliminating business competition from competing business actors in the relevant market, so that it is feared that it could give rise to monopolistic practices and unhealthy business competition. Predatory Pricing according to the law on monopolies and unfair Business competition is a trading activity oriented towards selling goods at a price that is cheaper than the market price in the study of al-ihikar jurisprudence, it mean hoarding or with holding to be sold, absolutely Haram (not just food items),This Is based on the words of the prophet SAW that whoever hoards has committed a sin.
