Abstract
The lowest wage that is legally required to be paid by employers to workers is the minimum wage, which aims to ensure welfare and prevent exploitation of workers. The determination of the minimum wage is usually carried out by the government based on various factors, including the cost of living, inflation rate, productivity, and overall economic conditions. This study discusses the impact of the application of labor wages from companies that do not comply with Government Regulation Number 51 of 2023 concerning Amendments to Government Regulation Number 36 of 2021 concerning Wages, solutions for companies that are not yet able to provide wages that do not comply with the minimum wage provisions set by the government, and the views of Islamic law regarding the provision of wages by companies that do not comply with the minimum wage provisions set by the government. This study aims to examine the phenomenon that occurs in society that there are still workers who are not worthy in terms of wage income, to provide solutions for companies that are not yet able to pay the minimum wage for workers set by the Government, and to understand from the perspective of Islamic law regarding the application of wages for workers in Indonesia. In this study, laws and regulations, case studies, legal theories, legal opinions, scientific book sources, and legal concepts related to the topics discussed. obtaining wages in accordance with the minimum provisions set by the government can have serious consequences that are detrimental to the company in various aspects, including reputation, productivity, and competitiveness. Overcoming the inability to pay minimum wages requires a comprehensive and collaborative approach, focusing on open dialogue between companies, workers, and the government. In Islam, all forms of exploitation and usury are prohibited, and the provision of wages that are not appropriate can be considered a form of exploitation that is prohibited by Islamic law.
