Abstract

Mediation is one of the alternative dispute resolution methods applied in court to resolve cases peacefully without going through a lengthy litigation process. This research aims to find out the process of implementing mediation in case settlement in sragen religious court, as well as the obstacles faced in its implementation. The research method used is a qualitative approach with data collection techniques through interviews, observations, and document studies. The results showed that mediation in Sragen religious court is similar to other religious courts, which refers to Perma No. 1 of 2008 concerning mediation. The process of implementing mediation does not escape the readiness of the parties, the skills of the mediator, and institutional support from the court. However, there are several obstacles such as the parties' lack of understanding of the mediation process, as well as other obstacles. Thus, efforts are needed to increase the socialization of mediation to increase the settlement of cases through mediation in religious courts.
