Abstract

iPhone 13 Pro Max HDC is a fake, fake or pirated form of the original iPhone 13 Pro Max. The purpose of this study is to find out the protection of intellectual property rights on the iPhone 13 Pro Max and legal liability for infringement of intellectual property rights of the iPhone 13 Pro Max. The approach method used in this study is a normative juridical approach. The type of data used is secondary data consisting of primary legal materials and secondary legal materials. The data collection method is carried out through literature studies. The data analysis method is guided by qualitative methods to produce information that is descriptive and analytical. The results of the study show that the legal protection of intellectual property rights for the iPhone 13 Pro Max is protected by Article 40 paragraph (1) letters f and s and Article 59 paragraph (1) letter e of the UUHC, Article 3 paragraph (1) of the Patent Law, Article 1 Number 1 of the UUDI, Article 1 Number 1 and Article 2 paragraph (3) of the Trademark Law, Article 1 Number 1 and 2 of the Constitution of the Republic of Vietnam. Legal liability for violations of the iPhone 13 Pro Max includes criminal and civil legal liability. Criminal liability is explicitly regulated in Article 113 of the UUHC, Article 54 paragraph (1) of the UUDI, Article 100 paragraph (1) and paragraph (2) as well as Article 102 of the Trademark Law, Article 161 of the Patent Law, Article 42 paragraph (1) of the Constitution. Civil law liability is regulated in Article 1365 of the Civil Code regarding unlawful acts and legal liability for business actors who violate the UUPK.
