Abstract

Indonesia was accused of dumping A4 Copy Paper from Australia in 2017. Indonesia was charged BMAD (Anti-Dumping Import Duty) by Australia because it was deemed to have sold A4 photocopy paper at dumping prices and was deemed to have committed PMS (Particular Market Situation). The aim of this research is to determine the process of resolving disputes over allegations of dumping by Australia. This research itself uses Normative Law and the analysis uses qualitative methods. The results of this research show that it is proven that Australia has violated 2 Articles of the Anti-Dumping Agreement. Australia violated Article 2.2 and Article 2.2.1.1. Regarding allegations of PMS, the WTO Panel decided that these allegations were baseless and unproven. In the end, Australia and Indonesia chose to implement the panel's decision within a jointly determined time period and did not submit an appeal to the WTO Appellate Body.
