Abstract
The trade in protected wild animals is a contributor to the scarcity and even extinction of animals in Indonesia apart from the reduction in forest land and damage to coastal ecosystems. The aim of this research is to find out the legal provisions of the practices of trade in protected wild animals in Indonesia with a review of the law in Indonesia and to find out the application of the law as well as the considerations of judges in giving decisions in cases of trade in protected wild animals. This research uses a normative method that examines and examines data sources obtained from library data resulting from previous research such as papers, national journals, online newspapers, books, archives and other documents, there are several types of legal materials, namely primary legal materials, secondary, and primary. Based on the author’s analysis of the judge’s legal considerations, he used Article 40 paragraph 2 of Republic of Indonesia Law No. 5 of 1990 concerning Conservation of Biological Natural Resources and Ecosystems because the judge saw the potential threat of damage to ecosystems and habitats arising from the criminal act trade in protected wild animals
