Abstract

This research aims to determine the implementation of sanctions for perpetrators of environmental pollution due to hazardous waste in West Cikarang District based on the enactment of Law of the Republic of Indonesia Number 32 of 2009 concerning Environmental Protection and Management. The issues discussed are: 1. How to apply criminal sanctions for perpetrators of environmental pollution due to B3 waste in Cikarang District. 2. Factors that hinder the application of criminal sanctions in relation to B3 factory waste in West Cikarang District and what efforts are being made to overcome these obstacles 3. The concept of applying criminal sanctions to perpetrators of environmental pollution. The research method used is normative research, research that focuses on laws and regulations. This research resulted in: 1. The application of criminal sanctions against perpetrators of pollution due to hazardous and toxic waste (B3) in West Cikarang District must be carried out carefully and in passing decisions must be in accordance with Law Number 32 of 2009 concerning Environmental Protection and Management. 2. Several obstacles or barriers, namely the lack of legal certainty regarding the boundaries that categorize the types of actions carried out and the resulting impacts. 3. The process of applying criminal sanctions involves a series designed to ensure that the perpetrator is responsible for his actions.
