Abstract

The aim to be achieved in this writing is what causes "the phenomenon of buying and selling used imported fashion products (thrifting)" and why this can become a criminal act. This research uses data from primary, secondary and tertiary legal materials using library study data collection techniques. This research shows the results that the creation of Law Number 7 of 2014 and the Regulation of the Minister of Trade is still deemed to be less effective, because there are still a lot of second-hand imported clothes circulating on the market, this really raises the question, is actually this second-hand imported clothing legal and worth buying and selling? or not. The Islamic religion actually allows its adherents to carry out buying and selling transactions, but this may be prohibited because the goods or objects being traded do not comply with the Sharia and violate applicable law.
