Abstract

The crime of theft has legal force, especially in Article 362 of the Criminal Code. However, there are restorative legal efforts to resolve the crime of petty theft, where the loss is no more than IDR 2,500,000.00 (two million five hundred thousand) and there are no casualties. In this research, normative juridical law is used. The type of data used and its sources are called primary data and secondary data, then the analysis is carried out using qualitative methods, which are then presented descriptively. Despite going through a long period of detention and various stages, the results of research on Court Decision Number 767K/Pid.SusLH/2018 show that the Judge's considerations have a justice perspective. It is hoped that the results of this research will provide advice for law enforcement to try to resolve minor cases outside of court if necessary.
