Abstract

This observation aims to understand how judges in deciding a case of criminal sexual violence against minors that occurred in the Kupang district court area. The approach used in this research is normative juridical, using descriptive research. Types of secondary data and literature data. The method of data analysis is qualitative data analysis which is so that everyone can understand the results of the research. The results showed that the crime of sexual violence against minors was in accordance with decision number: 223/Pid.Sus/2019/PN Kpg with an adult defendant and a minor victim who was fifteen years old, where sexual violence was committed five times. Where the act is subject to Article 81 Paragraph (2) of Law Number 17 of 2016 Jo Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. The law is used by the judge for juridical considerations, while witness testimony, letters, and the defendant's testimony are non-juridical considerations
