Abstract

This research was conducted with the aim of finding out the application of the provisions of Article 54 KUHAP in fulfilling the suspect's right to obtain legal assistance at the Surakarta City Resort Police as well as the obstacles faced during its implementation and also knowing about the fulfillment of the suspect's right to obtain legal assistance in terms of Islamic law. This research uses an empirical juridical approach. This research uses primary data sources and secondary data sources, primary data sources were obtained from interviews with investigators at the Surakarta City Police Department, and supported by secondary data obtained through library collection consisting of primary, secondary and tertiary legal materials. This research obtained the results that the application of Article 54 KUHAP related to fulfilling the rights of suspects to be given legal assistance has basically been fulfilled and carried out well by the Surakarta City Police based on a cooperation agreement with legal aid organizations or accredited Legal Aid Institutions, then through the police investigator, a letter of appointment of a legal advisor is issued which is submitted to the legal advisor concerned. The obstacles faced by Surakarta City Police investigators come from internal and external factors. Islamic law also supports the existence of fulfilling a suspect's right to be provided with legal assistance, so the Indonesian legal system and the Islamic legal system are aligned in their opinion regarding the importance of fulfilling a suspect's right to be provided with legal assistance. So the role of all law enforcement officials is very necessary to realize the implementation of Article 54 KUHAP.
