Abstract

The imposition of sanctions for acts of persecution in Indonesian football is often a debate whether it is enough to use Lex Sportiva alone or can use the Criminal Code, one of the cases of mistreatment occurred against referees in Liga 3 in 2021 committed by several players, the alleged perpetrators were reported to the police and threatened with Article 170 jo. 351 of the Criminal Code. The research method used is juridical normative using several approaches such as the statutory approach, the case approach and the comparative approach. The data collection method used is the literature study method. The results showed that in addition to Lex Sportiva, the Criminal Code can be used in handling cases of persecution in Indonesian football by referring to previous court decisions, the opinion of the East Java PSSI Asprov Secretary in 2019 and types of sports violence. In the jinayah point of view, the punishment that applies is diyat and ta'zir. It is known that in addition to Lex Sportiva, it turns out that the Criminal Code can be used in several cases of persecution in Indonesian football with several restrictions and referring to the indicators above
