Abstract

Spotify as an application that provides listening services on its journey has experienced problems related to Intellectual Property Rights. Spotify is sued because it is considered not to pay the musicians' licenses properly. They accuse Spotify of copyright infringement for using thousands of Wixen songs without proper licenses. The purpose of this study is a) to find out how to grant a license using a Spotify song playlist on a YouTube account; b) to find out about legal protection from spotify if another party lists a playlist of songs on a YouTube account. The approach method used in this research is normative method. The type of research used is descriptive. The research results are stated on The Spotify Community page. There are three communities that Spotify focuses on to support its development, namely: a) the Artist Community (Spotify for Artists); b) Developer Community (Spotify Developer); c) Brands Community (Spotify for Brands). Consumers can use songs from the Spotify application in commercial terms in the form of inclusion on a trademark must have an agreement as described in Article 1320 of the Civil Code which consists of 4 (four conditions), namely: a) There is an agreement between the two parties; b) Ability to perform legal actions; c) There is a certain thing; d) There is a lawful cause. The protection provided by spotify to members or consumers includes taking into account the rights granted under the Agreement, giving the right to; a) allow the Spotify Service to use the processor; b) provide advertisements and other information for members, and; c) allow business partners to do the same. The Spotify Service makes the Content available to members without modification. Violations committed by members if they continue to use songs are in the form of: a) Compensation; b) Litigation; c) Arbitration.
