Abstract
BPR is a bank that operates conventionally or based on Sharia Principles and does not provide services in payment traffic as part of its business activities. The aim of this research is to understand the form of entry into a business capital credit agreement with a BPKB guarantee, and the legal responsibility if the debtor defaults in a business capital credit agreement with a BPKB guarantee. The research method is a normative approach by examining legal principles, legal norms, legal rules and legal responsibilities regarding borrowing and borrowing money from savings and loan cooperatives with the nature of the research being descriptive analytical which will explain thoroughly and systematically the form of entry of business capital credit agreements with BPKB guarantees in the area. PT. BPR Inti Ambarawa Sejahtera. The data source in this research is using library research to search for secondary data and field research to obtain primary data. The research results show that the form of the credit agreement at PT. BPR Inti Ambarawa Sejahtera is a written agreement in the form of a standard agreement, the contents of the credit agreement at BPR Inti Ambarawa Sejahtera include the amount of debt, debt period, amount of interest, repayment time, clauses and collateral. The legal responsibility is in accordance with the provisions of Article 9 of the Agreement Credit No. 0334/PK-IAS/VII/2021 and Article 7 Agreement for Providing Guarantee with Fiduciary Transfer of Property Rights Number: 0334/PK-IAS/VII/2021.
