Abstract

In KHI (Compilation of Islamic Law) article 2 states that marriage according to Islamic law is a marriage with a very strong contract, namely mitsaqan ghalizan to obey the commands of Allah SWT and carrying it out is included in worship. The law emphasizes that when marrying, the bride and groom, both men and women, need mental and physical maturity to fulfill the goals of marriage well and have pious, healthy offspring and also that the marriage does not end in separation or divorce. According to article 38 of law number 1 of 1974, divorce is the breakdown of the marriage relationship. According to Islamic law, divorce is hated by Allah SWT. There are several factors behind the occurrence of divorce, one of which is continuous disputes and quarrels. The majority of disputes in early marriages are triggered because the partners who enter early marriages are not mentally ready to build a household. Moreover, both of them have a high level of egoism which sometimes causes conflict in the family, resulting in divorce.This research uses Normative-Empirical research, normative research is usually used to examine library materials or examine laws and legal regulations currently in force. Meanwhile, Empirical research is an approach used to describe a condition seen in the field as it is, in order to collect data information obtained directly in the field where the researcher is aiming, namely at the Wonosobo Religious Court. Normative-Empirical Legal Research is a research method that combines elements of normative law accompanied by the addition of empirical data. The data collection methods used were interviews, observation and documentation.From this research it can be concluded that divorce caused by disputes in early marriage at the Wonosobo Religious Court is the most common factor causing divorce.
