Abstract

Bank Muamalat Kupang branch is one of the first Islamic banks in the East Nusa Tenggara (NTT) region, precisely in the capital city of Kupang. We can know mathematically that the Muslim community in the area is recorded at only 9%; this data was obtained from the local government in mid-2007. This is related to the surge in population movements that arrive every year. The Bank Muamalat Kupang branch was established to improve the welfare of the people of Kupang city, considering that NTT is one of the poorest provinces in Indonesia. The establishment of Bank Muamalat is inseparable from the existence of customers from various circles, both ethnic and religious. This is in the opinion of the Operation Manager of Bank Muamalat Kupang Branch, Wahyu Hanantyo, who explained that for the development of services in the city of Kupang, Bank Muamalat does not discriminate between ethnicities, languages, and religions because of the fact that Bank Muamalat exists to serve the community and has universal characteristics. The birth of Bank Muamalat in the city of Kupang basically only wants to serve the community and never discriminates against customers, even though this bank is based on Islamic Shari'ah principles, and it can be known that 40% of customers of the Bank Muamalat Kupang branch are non-Muslims. In fact, non-Muslims also have a role in Islamic economic development, and there is no prohibition in it about the existence of non-Muslim customers, but keep in mind that the existence of customers is inseparable from things that are harmful. The role of Bank Muamalat in the existence of non- Muslim customers also needs to be carefully monitored by the relevant legal institutions, considering that every business activity or economic practice carried out by Bank Muamalat must follow the rules and principles of shari'ah that are regulated. Thus, the existence of some haram non-Muslim customer funds can affect the function and role of Bank Muamalat as a bank with sharia principles, in this case how Bank Muamalat can anticipate the entry of customer funds and also how to review the business activities of non-Muslim customers in Kupang city. The research method used in this study is field research, namely by using law in Action, namely sociological symptoms of law as incarnated by society in the behavior of its members. Data collection techniques include non-standard and unstructured interviews that are still focused on the subject matter, observation, and questioner. Based on the collected data, it is then analyzed using a deductive approach, namely by collecting data from the reality that occurs within Bank Muamalat and the customer's environment. Based on the results of the analysis obtained from the research data, it can be concluded that the income and utilization of non-Muslim customer funds by the Bank Muamalat Kupang branch can be categorized as not in accordance with the decision of DSN. Because, in principle, the shari'ah process of collecting and allocating funds has a very important role in reaching the source of funds and business activities of non- Muslim customers.
