Abstract
The world of education is also not spared from the existence of agreements in the implementation of important elements in education, one of which is the existence of a binding agreement between teachers as teaching staff and schools that do need educators but outside of civil servants whose function is to provide support and assistance in schools. The employment contract agreement between the teacher and the school aims to bind the parties in order to give rise to rights and obligations so that they can be accounted for. In general, the agreement is: The agreement of the parties about something that gives birth to an engagement / legal relationship and gives rise to rights and obligations, if it is not carried out as promised there will be sanctions. The method used in this study is a doctrinal (normative) approach. This research examines the law, which is conceptualized as a norm or rule that applies in society and becomes a reference for everyone's behavior. Before the agreement was made in carrying out the work agreement between SMP N 1 Ngargoyoso and Honorary Teachers. SMP N 1 Ngargoyoso and Honorary Teachers must fulfill legal requirements. The legal requirements that must be met by the shop tenants are regulated in Article 1320 of the Civil Code concerning the terms of a valid agreement. After the legal requirements have been fulfilled by the parties in the work agreement, then SMP N 1 Ngargoyoso and Honorary Teachers can enter into a work agreement. The parties to the work must fulfill the legal requirements of the agreement stipulated in Article 1320 of the Civil Code, after reaching an agreement between SMP N 1 Ngargoyoso and Honorary Teachers in a work agreement, a legal relationship arises in accordance with Article 1338 of the Civil Code between the parties which gives birth to rights and obligations. These rights and obligations are regulated in the deed of agreement signed by both parties. based on what was agreed in the work agreement, the parties first carry out deliberations to reach a consensus when there is a difference of opinion, be it a default and/or an unlawful act before being able to submit a claim to the District Court.
