Abstract
Theft is a crime that involves taking another person's property without the owner's consent. Surakarta in 2023 found a case of attempted theft. This research aims to provide an explanation of the judge's considerations in the crime of attempted theft with the weight of Decision Number: 143/Pid.B/2023/PN Skt. using qualitative writing methods, with the type of research using descriptive research, sourced from primary and secondary legal materials, using data collection methods through literature study. The results of the research show that attempted theft with weighting is sentenced to 5 months in prison in accordance with Article 363 Paragraph (1) 5th of the Criminal Code in conjunction with Article 53 Paragraph (1) of the Criminal Code.
