Abstract
Law enforcement imposed on children who commit criminal acts of theft is lighter than theft laws for adults. The development of the application of criminal law in Indonesia where children who commit crimes or criminal acts commonly known as "children" are still being processed legally, namely based on diversion. In an effort to overcome criminal acts committed by children, it is necessary to carry out comprehensive and thorough actions. the diversion carried out by the Sukoharjo Police is in accordance with Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and Article 364 of the Criminal Code even though it is carried out by monitoring children's activities even though the child is not detained and continues to be absent at the Sukoharjo Police every Monday and Thursday, even though the child is carrying out activities outside Sukoharjo there will be supervision from the investigator. This writing uses an empirical juridical method because in research the problems to be examined are related to regulations that are related to the reality of law enforcement of perpetrators of theft by children at the Sukoharjo Police. In jinayah, jarima sariqah is included in the type of hudud jarimah, which means that the act has been determined directly by Allah SWT or in other words an act has violated syara' law so that it cannot be changed or contested anymore.
