Abstract

In the COVID-19 pandemic, virtual hearings have become an important solution to maintain the continuity of the justice system in many countries, when physical distancing and social distancing are important. Fair trial, or a fair trial, is a fundamental concept in the legal system that aims to ensure that every individual facing the criminal justice process. The approach method used in this research is a normative juridical approach, namely the author examines data based on statutory regulations and other literature. The results of this research are that the virtual trial process includes 6 (six) stages consisting of: 1). Opening Session, including checking attendance and reading identity and indictment; 2). Examination of witnesses and rebuttal, consisting of summons, examination of witnesses, rebuttal and questions; 3). Examination of evidence and expert testimony, including examination of evidence and expert testimony; 4). Prosecutor's Opinion and Defendant's Defense, including the Prosecutor's opinion and defendant's defense; 5). Replicas and Duplicas, including replicas and responses; 6). The closing of the trial and determination of the decision includes the reading of the decision and the judge's explanation. One of the things in the virtual trial process that has the potential to Disrupt the principle of fair trial is that uneven accessibility or poor technological infrastructure can hinder the ability of the parties concerned, especially those who have limited access or understanding of technology, to participate effectively in the trial. virtual.
