Abstract

One of the crimes that occurred in Indonesia is the crime of making threats, the crime of making threats is regulated in the Criminal Code article 369. Restorative Justice is a further action from tradition within indigenous peoples which is taken as an alternative way to resolve a problem of a crime outside of criminal justice . The research method used in this research is empirical juridical. The results of this study indicate that under positive law, threatening health workers is considered a crime and can be subject to legal sanctions based on the regulations and laws in force in Indonesia. In the case of Threatening Health Workers at the Ngipang Surakarta Hospital, a mutual agreement was reached to forgive each other, this was sufficient for the elements of Restorative Justis in the Islamic Law Concept because it included Deliberation, Forgiveness, and Substitute Punishment (Diyat).
