Abstract

Online-based motorcycle taxi services are an era in which the use of the internet network is created by creating startups or online motorcycle taxi ordering applications through applications on smartphones. This study aims to determine the legal position of online start-up companies in agreements for transporting people and to determine legal protection for online motorcycle taxi drivers in agreements for transporting people. This study uses a doctrinal or normative approach, namely an approach by examining library materials or secondary data or what is called library law research. The type of research used is descriptive research. The results of the study show that the Online Startup Company is a third party whose role is to bring passengers and drivers together. Based on the provisions in the Transportation Law, the relationship between passengers and drivers is an indirect relationship because there is an intermediary, namely the Startup Online company. Transport law recognizes three principles of liability, namely liability due to errors, due to presumption, and absolute liability. Indonesian transport law generally adheres to the principle of liability for fault and for presumption.
