Abstract
The delegation received by outsourcing service companies is a form of delegation of daily operations and management from the company, this is a brief explanation of outsourcing. This study aims to determine the work implementation process, regulations, rights, obligations and responsibilities of Outsourcing between PT. Makmur Jaya Sragen as an outsourcing service provider with Surakarta City Hospital as an outsourcing service user and with outsourcing workers. With a doctrinal approach, namely how to research secondary data, it can be called library law research. This type of research is descriptive because the author will describe and explain data about the process of implementing outsourcing work between PT. Makmur Jaya Sragen as an outsourcing service provider with Surakarta City Hospital as an outsourcing service user and with outsourcing workers. The results of this study indicate that the process of implementing outsourcing work between outsourcing service providers and outsourcing service users and with outsourcing workers consists of several stages including the stage before or before the agreement occurs, the stage when the agreement occurs and the stage after or after the agreement has fulfilled the administrative requirements and legal requirements and in accordance with article 1320 of the Civil Code. Regulations related to outsourcing are regulated in Law Number 13 of 2003 concerning Manpower. The rights and obligations of each party have been regulated in the agreement, if one of the parties commits things outside the agreement then he must be responsible based on default in article 1243 of the Civil Code or responsible based on unlawful acts in article 1365 of the Civil Code.
