Abstract

False reports contain an untruthful element of an object that appears from the outside as if it were true, when in fact it is contradictory. This study aims to analyze the concept of false reports in decision no. 134/Pid.B/2022/PN Skw and decision No. 212/Pid.B/2022/PN Ktg, analyzing the reasons for the defendant making a false report both in decision No. 134/Pid.B/2022/PN Skw and decision No. 212/Pid.B/2022/PN Ktg and analyzed the guilt of the defendant in decision No. 134/Pid.B/2022/PN Skw and decision No. 212/Pid.B/2022/PN Ktg. This study uses a normative juridical approach. This type of qualitative descriptive research. The results of the study show that the concept of false reports in decision no. 134/Pid.B/2022/PN.Skw is that the defendant made a complaint that it seemed as if he had been mugged on the street, while the concept of a false report in Decision No. 212/Pid.B/2022/PN Ktg is that the defendant made a false report regarding the loss of a motorbike in order to avoid the leasing/dealer who would make monthly bills for the motorcycle. The reason for the defendant making a false report is in Decision No. 134/Pid.B/2022/PN.Skw was to have money which turned out to belong to his boss, while the reason for the defendant making a false report was in Decision No. 212/Pid.B/2022/PN Ktg is to avoid paying motorcycle loan installments every month. The defendant's mistake in decision No. 134/Pid.B/2022/PN.Skw is making a false report about robbery or robbery, while the defendant's mistake in Decision No. 212/Pid.B/2022/PN Ktg is to make a false report on the loss of a motorbike.
