Abstract

In implementing a business plan, a company may have many projects whose implementation will be handed over to other parties. The company will need assurance that the other party will fulfill its commitments under the contract. However, there is still a possibility that the project will not be implemented according to plan so that the company will suffer a loss, therefore, to guarantee the execution of a job on time and as desired, it is necessary to have an implementation guarantee. This type of research belongs to the qualitative research with the research approach used is normative-juridical. The data source for this study is PT Y. Furthermore, the data collection method used is document studies and interviews, then the data or information that has been collected is analyzed qualitatively, namely the method of research conducted to seek qualitative truth, namely data that is not in the form of numbers. The purpose of this research is to find out about the procedures or principles of implementing guarantees and constraints in the practice of implementing guarantees and all their legal consequences. The results of this study indicate that in the process of implementing implementation guarantees in accordance with DIRBI Circular Letter No.23/7/UKU stipulates that the analysis of Bank Guarantee issuance. The obstacles in the implementation of implementation guarantees are defaults, objection claims from the contractor.
