Abstract
Vigilante may be a translation of the Dutch term Eigenrechting which means how to take the law into the hands of your claims, taking rights without regard to the law, without government information and without using instruments of government control. The reason for this consideration is to decide on the regulation of eigenrichting by society against robbery perpetrators with barbarity in view of the Positive Law and the Islam Law in Indonesia. Eigenrichting carried out by the community in the perspective of Positive Law and Islam Law in Indonesia is carried out in doctrinal legal studies. These legitimate questions about strategy can be normatively-empirically legitimate questions about strategy. The creator used a kind of obvious question. The examination used is a clear examination. The results of his research, the sanction for perpetrators of vigilante violations (eigenrichting) according to positive criminal law is Article 170 paragraph (2) number 3 of the Criminal Code with a maximum prison sentence of 12 years. Then according to Article 351 paragraph (3) of the Criminal Code with a maximum detention of 7 years. Whereas in the Islam criminal law, vigilante acts (eigenrichting) are included in qishash and diyat fingers.
