Abstract

Fish buying and selling transactions carried out by almost all fishermen in UjungLabuang Village are by selling fish picked up by buyers, while those contained in the Muslim Shaheh Hadith explain that the Prophet forbade to empty (intercept) trade caravans before they knew the price in the market. In Paga Village, almost all fishermen make fish buying and selling transactions with traders who pick them up at sea. Therefore, it is necessary to explain how Islamic law reviews the sale and purchase of fish in the sea to fishing communities in Paga Village, Sikka Regency. This study aims to explain how the transaction model and explain the perspective of sharia economic law on buying and selling fish at a fish auction site in Paga Village, Sikka Regency. This type of research is qualitative with a normative theological approach, and a phenomenalogical approach. The methods used include observation, interviews and documentation. The results showed that buying and selling transactions carried out by fishing communities in Paga Village were very profitable for them. This is based on several things. First, based on market demands, if the fish obtained by fishermen is directly purchased by collectors, the fish will remain fresh until it reaches the market. Unlike if the fishermen themselves bring it to the market, of course it will take a long time because they still want to live in the sea. Second, this transaction will make it effective for fishermen to return to fish because of their catch that has previously been purchased. Based on the rules of maslahah, buying and selling transactions like this are permissible because there are many benefits obtained compared to the losses.
