Abstract
In making an agreement, the parties are free to choose whatever they want to be described in the agreement, as long as it does not conflict with the applicable regulations and norms. The Onsyi partnership agreement is an agreement made by the parties based on mutual benefit, need and trust. The purpose of this research is to find out the Implementation of the Principle of Contractual Freedom in the partnership agreement between Drivers and the Onsyi Company and to know the Implementation of the Rights and Obligations of the parties in the partnership agreement between the Onsyi Company and Onsyi Partners. The research method used by the author is empirical juridical. The type of research used is descriptive. The data used are primary and secondary data. Data collection by interviews and literature study. Qualitative data analysis method. From this research, it was found that the implementation of the principle of freedom of contract is limited, meaning that not all scopes of the principle of freedom of contract are implemented in the onsi partnership agreement. The implementation of the rights and obligations of the parties in the onsyi partnership agreement is going well, the parties carry out their obligations properly and if someone violates them, there will be sanctions that will be received.
