Abstract

Protection of social welfare of children is a state obligation as is the state of Indonesia which is a welfare state. Children have the right to protection and guarantee of children's rights which are regulated in Article 28B paragraph (2). Apart from that, the state, government and local government guarantee the protection of children's welfare as stated in Article 23 paragraph (1) of Law No. 35 of 2014. Social welfare problems for children in 2020-2021 have experienced a significant increase, especially in Sragen Regency. This underlies the establishment of Integrative Child Social Welfare Centers in various regions in Indonesia. This study aims to determine the regulation of the Integrative Child Social Welfare Center (PKSAI) in Indonesian laws and regulations and the effectiveness of the role of PKSAI Sragen in protecting the social welfare of children in Sragen Regency. Based on these problems, this study uses an empirical juridical research approach with data collection techniques in the form of literature studies and interviews supported by qualitative data analysis techniques with deductive reasoning. The results of the study show that PKSAI arrangements in statutory regulations are in the Regent's Regulations which are one of the regional laws and regulations that are recognized and binding in accordance with Hans Kelsen's hierarchical theory of statutory regulations. Then, based on data from both literature studies and field studies, namely interviews according to indicators that PKSAI Sragen can be said to be effective in protecting the social welfare of children in Sragen Regency. The implementation of PKSAI Sragen is in accordance with Sragen Regent Regulation Number 63 of 2020 concerning PKSAI Sragen.
