Abstract
In this essay, the decisions Number 16/Pid.Sus/2021/PN Sos and Number 254/Pid.B/2020/PN Gns regarding decency crimes and decency infractions are compared from a legal perspective. An approach incorporating both normative data and case studies was used for the analysis. The study's findings demonstrate that there are discrepancies between the two choices' legal conclusions about the crime's elements, the assessment of the evidence, the penalty, and the decision's justifications. In contrast to judgment Number 16/Pid.Sus/2021/PN Sos, decision Number 254/Pid.B/2020/PN Gns contains a more thorough and convincing criminal element. Decision Number 254/Pid.B/2020/PN Gns evaluated the evidence based on witness statements, while Decision Number 16/Pid.Sus/2021/PN Sos evaluated the evidence based on electronic records. In conclusion, although the two rulings differ in some legal facets, they both serve the same purpose— namely, to provide victims justice and deter future instances of the same crime. In order to improve the development of the legal elements of law enforcement and deepen their understanding of immoral crimes and decency violations, law enforcers and academics can use this research as a resource.
