Abstract

Children are a mandate given by Allah SWT and we must provide protection during their growth and development so that they can grow into adult humans for the future of the nation. Human life has progressed from time to time. One of them is the existence of technological advances such as the internet. The advancement of internet technology besides having a positive impact also has a negative impact. Negative impacts arise, namely the increasing variety of crimes by utilizing technological advances. One example is Child Grooming. The purpose of this study was to find out the forms of communication on social media that can be categorized as Child Grooming, Knowing the fulfillment of the criminal elements of Child Grooming in social media so that it can be said as a crime in Indonesia and knowing Child Grooming from an Islamic perspective. The method used in this research is normative method. The results of the study show that forms of communication on social media can be categorized as Child Grooming. Furthermore, regarding the fulfillment of the criminal element of Child Grooming, it is in accordance with Article 76 I of Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning Child Protection, in accordance with Article 37 of Law Number 44 of 2008 concerning Pornography, and Article 45 Paragraph (1) Jo Article 27 Paragraph (1) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions. Child Grooming according to an Islamic perspective is that the perpetrator can be sentenced to stoning.
