Abstract
The regulation of trademarks is regulated in Law Number 20 Year 2016. Basically, the registration of a trademark must be based on good faith. Based on this, if there is a trademark that is indicated to be registered in bad faith, then a trademark cancellation lawsuit can be filed against the relevant trademark by the party who feels harmed by the registration of the trademark. One of the trademark disputes caused by the existence of bad faith is a trademark dispute between the 7 DAYS brand and the 5 DAYS brand whose case is in the decision of the Commercial Court Number 71/Pdt.Sus-Merek/2020/PN.Niaga.Jkt.Pst. This study aims to determine the criteria of bad faith in the cancellation of registered trademarks according to Indonesian law, a case study of the decision of the Commercial Court Number 71/Pdt-Sus/Merek/2020, and to determine the legal protection given to well-known trademarks according to Indonesian law. The type of research used in this research is the normative juridical research. The results show that if the provisions of Article 21 of Law No. 20 Year 2016 and its explanation are associated with the trademark dispute between 7 DAYS and 5 DAYS, it can be seen that the registered trademark of 5 DAYS has similarities in essence to the 7 DAYS trademark that has been registered earlier, where the similarity in essence is one of the criteria of the element of bad faith. The existence of bad faith from the owner of the 5 DAYS trademark is proven in the Commercial Court resulting in the cancellation of the registration of the 5 DAYS trademark. Legal protection provided by the Law Number 20 Year 2016 to well-known trademarks in Indonesia against trademark infringement practices can be done preventively and repressively.
