Abstract

The objective to be reached from this discussion is to discover what factors motivated the formation of the TPKS law and the urgency of its ratification and enforcement, as well as Islamic legal views on sexual violence. This study uses a normative methodology with a descriptive analytical character. The data used are primary, secondary and tertiary legal documents with library study data collection techniques. The results of the study show that the law that regulates sexual violence before the TPKS law is ineffective because the law is not comprehensive and has several weaknesses both in the law itself and in enforcement efforts. of the law which are influenced by several factors, while currently Indonesia is experiencing an emergency of sexual violence which comes in various forms and has a very detrimental impact on the victim. Protecting all people, especially women and children in Indonesia from sexual violence is an effort to uphold human rights as it is stipulated in the 1945 Constitution. Islamic law regards sexual violence as a forced adultery, so the perpetrators may be subject to severe penalties under national laws. Islamic law and Islamic law, while victims of sexual violence are not subject to any punishment.
