Abstract

Insult or defamation is regulated in Article 310 paragraph (1) Criminal Code and one way to resolve it is wit a restorative justice approach. The purpose of this study to determine the basis for the regulation of the settlement of criminal cases in Indonesia with a restorative justice approach, the imposition of criminal acts of insult or defamation by judges and the perspective of Islamic law in Decision Number 159/Pid.B/2016/PN. Msb. The research method is normative juridical. The results of the study show that the basic arrangements regarding the settlement of criminal cases in Indonesia with a restorative justice approach have been regulated in a joint decree. Legal considerations from PN judges. Masamba Number 159/Pid.B/2016/Msb in imposing a sentence is in accordance with the applicable laws and regulations. Acts of humiliation or defamation are prohibited by Islam and the resolution of a problem first use peace.
