Abstract

Lately, it's been happening until it's been widely discussed in the real world as well as in cyberspace or social media, namely LGBT actions. The existence of LGBT is very unusual in terms of sexual behavior in Indonesia. Moreover, there is a case carried out by TNI personnel in the criminal case Number. 49-K/PM.II-09/AD/III/2020. Therefore, this study aims to provide a legal perspective on this LGBT act, which is specifically carried out by TNI personnel. It is hoped that more and more laws will be enforced to protect the general public from the practice of sexual harassment and LGBT behavior. In addition, the public's view of the law that rejects LGBT acts with sexual harassment can also be seen from the increasing number of social sanctions aimed at perpetrators. Researchers in analyzing using normative juridical methods. Qualitative descriptive research in this study refers to the analysis of the criminal case Number. Number. 49-K/PM.II-09/AD/III/2020 concerning same-sex sexual abuse by TNI personnel, with the type of data, namely the criminal case Number. 49-K/PM.II-09/AD/III/2020. The results showed that the District Court's decision on the act of same-sex sexual abuse by the TNI stated that the defendant had committed a violation as stipulated in Article 281 of the 1st Criminal Code in conjunction with Article 26 of the Criminal Procedure Code, Article 190 paragraph (1), paragraph (3), paragraph (4). RI Law number 31 of 1997 concerning Military Courts and other relevant statutory provisions.
