Abstract

Islamic law has paid attention to the existence of the family, including marriage. Marriage is one of the goals of Islamic law to maintain the integrity of religion, honor, money and offspring. to realize a legal and true marriage. Adultery is one of the biggest problems in marriage. The issue of adultery refers to the patience of a girl resulting from adultery. This thesis is a desk research that adopts an inductive method and a comparative analysis of the condition of daughters resulting from adultery in marriage according to Indonesian law and Islamic jurisprudence. And the research problems consist of: 1. How is the guardianship of adulterous girls in marriage? What is Islamic law and jurisprudence in Indonesia in that ? 2. What is the legal guardianship of a girl who commits adultery in marriage according to Indonesian law and Islamic fiqh? After conducting research on Islamic law and fiqh, it was found that girls who commit adultery are like legitimate girls in all provisions and rights except in the case of marital guardianship and those related to it. Sharia and the government have stipulated this in a special provision that shows it. In addition, Indonesian Islamic law and jurisprudence do not fully comply with the rules for the guardianship of adulterous girls.
