Abstract

NFT is a relatively new technology hence the scope of NFT does not yet have a regulation that regulates the emergence of NFT in the Digital world. This study aims to determine the legal protection of digital artworks are sold without permission in the form of NFT (Non-Fungible Token) on the Opensea website. This implementation resulted in changes to the OpenSea site. Learning about the risks that can occur when there is a violation of NFT's artwork without the permission of the creator. Using the smart contract system as a means of buying and selling agreements between investors and creators. The research used is qualitative research with a qualitative descriptive analysis method that uses data collection from theoretical studies. Based on the research results, property rights and copyrights are two different aspects that corelates to NFT works. However, copyright and property rights are not always the same owner because the copyright holder can sell NFT to other parties, and the party will have fully ownership rights to the NFT.
