Abstract
An agreement or contract literally means a written document containing an agreement between two or several people to achieve the goals as mutually agreed upon, the agreement has a binding nature for the parties. While business is an action carried out by someone which contains commercial value. So it can be concluded that a business agreement is a form of agreement in written form where the substance has been agreed upon by the parties bound in it and also has commercial value. This study aims to determine whether the Covid 19 Pandemic can be categorized as a state of coercion or Force Majeure, what factors cause force majeure in an agreement and what are the legal consequences of force majeure on an agreement. The approach method used in this research is a normative-descriptive approach. This type of research is normative. The results show that in the case of the Covid-19 pandemic, force majeure is a relatif or temporary situation, namely a situation where an agreement can be fulfilled but it is not in accordance with the agreed time (delay), so it only postpones or suspends the debtor's contractual obligations and does not cancel the business contract. . The business contract remains valid and binding on the parties. Based on the cause, force majeure has several factors that make an event fall into the category of coercive circumstances including natural, social or emergency factors, economics, government policies or regulations as well as unpredictable technical factors. In the event of force majeure, in accordance with the provisions of the Civil Code, the debtor cannot be required to pay fees, losses and interest to creditors.
