Abstract

The goal to be achieved in this study is to find out the legal arrangements for goods that are not in accordance with the agreement (orders) in buying and selling transactions through Instagram social media to find out legal responsibility for goods that are not in accordance with the agreement (orders) in buying and selling transactions through social media. Instagram. The method used by the author is empirical juridical, namely by implementing normative legal provisions (laws) in action on certain legal events that occur in a society. The results of the research obtained are as follows: buying and selling in general (conventional) and buying and selling online, the difference is only in the media used according to Article 1458 of the Civil Code. This method of payment in buying and selling transactions through Instagram social media can be done by using a transfer system via ATM, this is in accordance with Law Number 3 of 2011 concerning fund transfers, credit cards are in accordance with Article 1 paragraph (11) of the Law. , Number 11 of 1998 concerning Banking or conducting COD or (cash on delivery) in accordance with Article 15 paragraph (1) UUITE. Legal protection if the seller defaults in the form of compensation such as replacement of goods, or discounts on goods prices, compensation and refunds, this is in accordance with the provisions of Article 4 of the Consumer Protection Act. Meanwhile, the protection aspect in terms of criminal law can be done by reporting to the authorities as stated in Article 378 of the Criminal Code concerning Fraud, Article 35 and Article 51 Paragraph (1) of Law Number 11 of 2008 concerning Information and Electronic Transactions. as amended by Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions.
