Abstract

Lease is an agreement whereby one party binds himself to give the other party the enjoyment of an item, for a certain period of time and with the payment of a price which the latter party is able to pay. Such is the definition given by Article 1548 of the Civil Code regarding the lease agreement. According to article 1548 of the Civil Code, a lease is an agreement in which one party binds himself to give the other party the enjoyment of an item, for a certain period of time with the payment of a price which the latter party is willing to pay. Shophouses are found in many big cities in Indonesia and are usually occupied by middle class residents. The shophouse rental agreement is widely used by the parties in general, because the existence of this shophouse rental agreement can help the parties, both the shophouse tenants and shophouse owners, will benefit from each other. Shophouse tenant benefit from the enjoyment of the shophouses that are rented, and shopkeepers will benefit from the rental prices that have been provided by the shophouse tenants. A reciprocal agreement is an agreement that gives rise to rights and obligations to both parties, and these rights and obligations have a relationship with one another. That the lease agreement is due to the existence of a period of time, the agreement contains the risk that the rights and obligations imposed on the parties are not carried out properly, such as the occurrence of default, or others, it requires good faith from both parties.
