Abstract

A suspect planning to commit a criminal act will deal with the state through law enforcement officials to find out if a criminal act is suspected. The right to legal assistance should be given to suspects, especially for those who are unable and for those who do not understand the law for the sake of defending the suspect. Law Number 8 of 1981. Legal aid is a fundamental right guaranteed by the state both in the constitution and in other laws and regulations. Legal aid is an obligation that must be provided by the state if someone is involved in legal problems because the right to legal assistance is an umbrella for the rights of other suspects. Legal assistance provided in an effort to protect suspects from being given their rights during the investigation process. This research is a descriptive legal research because in this research it tries to systematically provide actual facts by providing a systematic description of legal protection against the neglect of legal aid in the process from the perspective of human rights.
