Abstract

Cryptocurrency transactions using bitcoin are transactions that are not carried out directly but are carried out virtually in contrast to transactions using the rupiah currency. This results in transactions using bitcoin cryptocurrencies that have the potential for fraudulent crimes, one of which is default. This study aims to determine law enforcement and the inhibiting factors for law enforcement in bitcoin Cryptocurrency transactions so that it is hoped that criminals in bitcoin Cryptocurrency transactions can be punished. While in Indonesia itself the rules regarding transactions using Cryptocurrency are not very clear and many people do not know so that they are often used by certain people to commit crimes in transactions.In this study, using a normative juridical approach with qualitative techniques to obtain research results that are in accordance with the research objectives. From the research conducted, it is found that there are several factors that become obstacles in law enforcement of bitcoin Cryptocurrency transactions, one of which is the not recognizing bitcoin as a legal tender in Indonesia. For perpetrators of crimes in Cryptocurrency transactions using bitcoin, they can be charged with the criminal act of fraud, namely Article 28 paragraph 1 related to Article 45A and several other articles.
